Act 44

Chapter 7-A of Act 44 of 2009 mandates all parties to a service contract with a municipal pension fund submit an annual disclosure to their Pennsylvania public sector clients. Tionesta Borough has a Non-Uniformed Pension Plan for the full-time employees and the pension plan is administered by Northwest Bank. The disclosure form provides certain information in regard to any financial relationships that may exist between the entities and the elected and appointed officials of the municipality to determine if a conflict of interest may exist. The form was sent to all entities that provide services to Tionesta Borough

When the Municipality receives the completed form, the Municipality determines if there are any conflicts of interest. The Municipality should file these completed Disclosure Forms with the pension plan documents. If the Municipality maintains a website the disclosure forms must be posted on the municipality’s website and be filed and updated annually for the life of the contract between the municipality and each party.
